In August, the CBV announced that it would restrict women's competitions to female biological sex athletes. The rule provides for genetic screening of the SRY gene and according to the entity applies to national tournaments such as the Super League and the Super Cup. For fans, the announcement meant that participation in these tournaments was now accompanied by a criterion that soon became legal dispute.

Osasco had managed to register all the athletes for the tournaments, but Tifanny's situation was pending. The situation was recorded late yesterday afternoon as UOL showed. So even with the club having forwarded the list, the individual issue remained open and now depended on a decision.

STJD denies bail, and defense takes the dispute to common court

The defense of the athlete and the club filed with a Mandate of Guarantee in the Superior Court of Sports Justice (STJD), but the request was rejected. With this, the dispute was brought by the defence to common justice.

Provisional decision applies only to Tifanny and does not define CBV's POL policy

The ruling, however, is provisional and applies only to Tifanny. The order comes from Judge Antonio Luiz da Fonseca Lucchese of the 44th Civil Court of the Capital Region. In the text, the judge states: "The present decision does not rule on the validity of POL ethics [which banned trans athletes], whose examination is reserved for the forum deemed competent".
